August 22, 2004 - Mr. Justice Peter Martin of the Court of Queen's Bench awarded costs in the recent lawsuit by Mr. Gus Barron against the Calgary Montrose Nominating Committee to Mr. Barron in the sum of $38,000.00. It will be interesting to see how fast these costs are paid by the Nominating Committee to Mr. Barron and where the funds will be coming from.

August 13, 2004 - It was announced today by the Calgary Montrose Nominating Committee that Nominating Day (the day we go to vote
for the PC Candidate for Calgary Montrose) will be Sunday, Sept. 12, 2004,
between the hours of 1 p.m. and 7 p.m. The vote will take place at Eastside City Church, 1320 Abbeydale Drive S.E. (at the end of Memorial Drive). Bring your PC membership card. If you don't have a PC membership card
and want one (which you need in order to vote,
Gus once again has been denied a supply of cards by the Nominating Committee. You will have to go to this same Eastside City Church
between the hours of 5 p.m. and 8 p.m.,
Monday through Saturday, to pick one up for yourself.

July 30, 2004 - The democratic rights of Calgary Montrose PC members
have been preserved in court, according to a decision laid down today
by Mr. Justice Peter Martin of the Court of Queen's Bench.
Mr. Gus Barron, in his lawsuit against the Nominating Committee
for Calgary Montrose, was vindicated, as the judge ruled in his favor.

June 20, 2004 - It has come to Gus's attention that the Nominating Committee and/or Constituency Board of Calgary Montrose has failed to notify it members of the suspension of the nominating process. While Gus agreed to go to arbitration or mediation about his dispute
with the Nominating Committee over access to membership cards, the Nominating Committee simply chose to deny Gus access to those cards, thereby terminating Gus's opportunity to represent you.
The Nominating Committee then disqualified Gus from the race
because of his complaint to PC Alberta about this undemocratic decision
(the denial of membership cards). The matter is now before the courts,
and Gus has incurred great legal fees to afford the Calgary Montrose PC members the opportunity to vote and decide for yourselves
whom you want as your representative.
Gus believes that he will be vindicated in court,
and you will get the right to chose by voting at a later date
who will represent you in the Legislative Assembly.

June 14, 2004 - The matter of the vote is on hold until the lawsuit
instituted by Gus Barron against the Nominating Committee
for Calgary Montrose has been decided by the courts (the case has been scheduled for hearing at Court of Queen's Bench on July 28, 2004,
after the presiding judge ruled against the Nominating Committee's
request for delay of the trial). The Gus Barron Campaign website
will try to keep you informed regarding further news updates.

VICTORY !

On July 30, 2004, Mr. Justice Peter Martin ruled in favor of Mr. Gus Barron, in his lawsuit against the Calgary Montrose PC Nominating Committee. Justice Martin stated that the procedures and process followed by the Nominating Committee did not follow natural justice. In his decision, Justice Martin stated that the process and procedures that the Nominating Committee for Montrose followed were not open, fair and democratic.

The judge set aside the disqualification of Mr. Barron as a PC candidate for nominee for the Calgary Montrose district, he set aside the acclamation of Mr. Hung Pham as winner of the nomination procedure by default, and he directed that the nomination process restart. The judge has given the Nominating Committee a minimum of one month to six weeks to accomplish the vote.

The democratic right of the people of Calgary Montrose PC members were preserved and can now have their say by voting. The vote will proceed by September 13, 2004, at the latest, according to Mr. Justice Martin's ruling.

June 20, 2004: There is no truth to the rumors that Gus has stepped down from the constituency race. Nor is there truth about the incumbent being acclaimed the victor for PC representation
in Calgary Montrose.

June 14, 2004: The PC Party has frozen the nomination election until either (1) a judge has ruled on the motion instituted by Gus Barron vs. the Nominating Committee to overturn a ruling disqualifying him arbitrarily from the nominations race, without hearing or just cause; or (2) the Party has had time to review the representations of both sides in the dispute and to make some kind of in-house ruling.
